PERM Labor Certification

PERM Labor Certification, which stands for Program Electronic Review Management Labor Certification, is a crucial step in the process of obtaining an employment-based immigrant visa (Green Card) in the United States for foreign workers. It is specifically used in the employment-based preference categories, such as the EB-2 and EB-3 categories, which are designed for individuals with advanced degrees or professional skills and workers with less specialized skills, respectively.

EB-1, Extraordinary Ability, or Outstanding Professor or Researcher

The EB-1 visa, informally known as the “Einstein” visa, is a United States employment-based permanent residency category designated for individuals classified as “priority workers.” These priority workers consist of foreign nationals who possess either “extraordinary talents,” serve as “outstanding professors or researchers,” or encompass “certain executives and managers of foreign corporations being relocated to the United States.” This visa category grants them the privilege of permanent residence in the United States.

National Interest Waiver (EB-2)

A national interest waiver (NIW) provides a pathway to secure a green card without the necessity of a job offer (skipping the PERM Labor Certification process). This avenue is available to specific individuals who possess an advanced degree or exhibit “exceptional ability” in fields such as science, arts, business, or other professions. To be eligible for an NIW, the individual must demonstrate that their contributions have a substantial economic impact or significantly advance human welfare.

O-1, Extraordinary Ability or Achievement

The O-1 nonimmigrant visa is for the individual who possesses extraordinary ability in the sciences, arts, education, business, or athletics, or who has a demonstrated record of extraordinary achievement in the motion picture or television industry and has been recognized nationally or internationally for those achievements.

L-1, Intracompany Transferee Executive or Manager

The L-1A nonimmigrant classification enables a U.S. employer to transfer an executive or manager from one of its affiliated foreign offices to one of its offices in the United States. This classification also enables a foreign company that does not yet have an affiliated U.S. office to send an executive or manager to the United States with the purpose of establishing one.
